Terms of Service

These Terms of Service (“Terms”) govern your use of Commercial American (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Community Guidelines. Dealers also agree to the Dealer Terms.
1. What the Service is
Commercial American is an online venue where private sellers and dealers advertise commercial vehicles and buyers contact them. We are not a party to any transaction. We do not own, inspect, appraise, finance, title, insure or deliver vehicles, and we do not hold or process payments for vehicle sales. Any sale is solely between buyer and seller.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your information, for keeping your password secure and for all activity on your account. One person or business may not create accounts to evade a suspension.
3. Listings
- You may list only vehicles you own or are authorized to sell, located in the United States, and only commercial or work vehicles that fit our categories.
- Listings must be accurate and complete, including price, mileage, condition and title status. Disclose known defects, salvage/rebuilt titles, liens and odometer discrepancies.
- Photos must show the actual vehicle. The cover photo must show the outside of the vehicle.
- Remove or mark a listing as sold promptly once the vehicle is no longer available.
- We may review, edit for format, reject, pause or remove any listing and may require approval before a listing goes live.
4. Prohibited conduct
You may not post false, misleading or fraudulent content; request deposits, wire transfers or gift cards for vehicles a buyer has not seen; misuse other users’ contact information (including for unsolicited marketing); scrape the Service; interfere with its security; upload malware; or violate any law, including federal and state consumer protection, advertising, odometer-disclosure and anti-discrimination laws.
5. Communications
When you contact a seller through the Service, you agree the seller may contact you about that vehicle. Sellers must use buyer information only to respond to that inquiry and must comply with applicable telemarketing, text-messaging and e-mail laws.
6. Fees
Listing on the Service is currently free. If we introduce paid features, we will tell you in advance and you will only be charged if you choose to buy them.
7. Content license
You keep ownership of content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, resize and distribute it in connection with operating and promoting the Service, until it is deleted. You confirm you have the rights to everything you upload.
8. Suspension and termination
We may suspend or terminate accounts that violate these Terms or put other users at risk. You may delete your account at any time from Profile & Privacy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY OF LISTINGS, THE IDENTITY OR CONDUCT OF USERS, OR THE CONDITION, TITLE OR LEGALITY OF ANY VEHICLE. A “Verified Dealer” badge means we reviewed business information at the time of verification; it is not a guarantee of any vehicle or transaction.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM TRANSACTIONS BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnity
You agree to indemnify us against claims arising from your listings, your transactions with other users or your violation of these Terms or the law.
12. Governing law and disputes
The governing law, venue and dispute-resolution terms for the Service will be confirmed by the operator before public launch. Nothing in these Terms limits rights you have under applicable consumer protection law.
13. Changes
We may update these Terms. Material changes will be announced on the Service before they take effect. Continued use after the effective date means you accept the updated Terms.
